PrivacyIceberg is an automated service that helps users request the removal of their personal data from data broker websites and similar third-party entities. Users submit personal information via our platform, and we generate and send removal requests on their behalf.

We do not guarantee responses from data brokers, nor do we provide confirmation of removals. The Service is limited strictly to request generation and submission. Users are encouraged to verify removal status independently where possible.

2. Eligibility and Account Use

You must be at least 18 years of age to use the Service. You are responsible for providing accurate and lawful information and maintaining the confidentiality of your account credentials.

3. No Refund Policy

All payments made for the Service are final. Due to the nature of our automated system and irreversible request submission process, we do not offer refunds, credits, or partial reimbursements under any circumstances. By subscribing or purchasing, you acknowledge and agree to this strict no-refund policy.

4. User Responsibilities

You agree not to use the Service for any unlawful or fraudulent activity. You must ensure the accuracy and legitimacy of all information submitted to us. We reserve the right to suspend or terminate your access without notice if misuse or violation is detected.

5. Limitations of Service

We act solely as a facilitator of data removal request submission. We do not operate or control the data broker websites and cannot compel them to honor or acknowledge removal requests. No guarantees are made regarding the effectiveness, completeness, or timeline of the removal process.

Users should understand that results may vary based on the specific practices and policies of each data broker. We do not track individual listing statuses or confirm whether specific data has been removed.

6. Modifications and Availability

We reserve the right to update, modify, suspend, or discontinue any part of the Service at any time. Such changes may occur with or without prior notice. Continued use of the Service following updates constitutes your acceptance of the revised terms.

7. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind. We disclaim all warranties, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure. You understand and agree that you use the Service at your own risk, and that we are not liable for any loss of data, business interruption, or damages arising from your use.

8. Limitation of Liability

To the fullest extent permitted by law, PrivacyIceberg, its affiliates, directors, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

Our total liability for any claim related to your use of the Service shall not exceed the total fees paid by you in the previous six months. You agree that this limitation is a fundamental part of the agreement and reflects a fair allocation of risk.

9. Indemnification

You agree to defend, indemnify, and hold harmless PrivacyIceberg, its officers, employees, contractors, and affiliates from any claims, damages, obligations, losses, liabilities, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

10. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada. Any disputes or legal proceedings shall be resolved exclusively in the courts located in Toronto, Ontario. By using the Service, you consent to the jurisdiction of these courts.
